Please carefully read through these General Terms and Conditions regarding the licensing and delivery of images before using this website or ordering image licenses. You must agree with the General Terms and Conditions in order to purchase.
The website www.picbazzar.com and its services are a product of the company Sikdar International IT Hub Private Limited. Sikdar International IT Hub Private Limited operates a plattform for online sales of royalty-free image licenses for digital images. . The General Terms and Conditions are valid within the scope of an ongoing business relationship as well as for all future product offers, services, orders, contract completions and deliveries, even if not explicitly mentioned.
All offerings, shipments, and granting of license rights are without engagement only and do not exclusively apply to the following General Business Terms and Conditions. Any conditions deviating from these terms must be agreed on in writing; opposing terms and conditions from contractual partners shall only apply with explicit written approval from PicBazzar.
picbazzar allows customers free access to the online database www.picbazzar.com. Customers may use the database to search online for photos stored there and transfer them as preview images or licensed high-resolution images.
Prior to conclusion of the first contract, the customer must register with picbazzar. In doing so, he receives a user name and password, which are treated as confidential. Transfer to third parties is not permitted. If access data is abused at the fault of the customer, they are responsible for the resulting damages.
Conclusion of the contract takes place strictly via the Internet. In order for the contract to be concluded, the customer confirms a second time while placing the order that he understand and accepts these General Terms and Conditions. Only then shall the order and payment procedures be successfully concluded and the customer granted access to download the respective images. The images will remain in the customer's personal account and available for download for lifetime after purchase.
Customers shall hold claim to constant accessibility to the picbazzar database. picbazzar may at anytime temporarily or permanently shut down the server as well as change, delete or add to the contents stored there.
Any kind of automated access to picbazzar images or the database using external scripts, download managers or other comparable functions/tools outside of the prescribed ordering process is prohibited and subject to criminal prosecution. The customer is subject to a penalty of up to INR 50,000 for every infringement or attempted infringement.
Image offered on www.picbazzar.com are provided for sale by multiple photographers. The images are subject to copyright protection. Ownership rights and copyrights are non-transferable even with compensation for damages and/or other charges and fees. With payment of the licensing fee, the customer acquires the non-exclusive, worldwide, non-transferable and non-sub-licensable right to use the selected images for his own information, illustration or advertising purposes. All other rights to the images, including all copyrights, shall remain with Shotshop and the photographer respectively. If an image is labeled "only for editorial use", the image is only approved for editorial purposes (press articles, reporting, teaching materials). Shotshop offers two different types of image licenses: the Standard license and the Extended license.
The standard license allows the non-exclusive, worldwide, non-transferable and non-sub-licensable right to use of the images for the Permitted Uses (as defined below). All other rights in and to the images including, without limitation, all copyright and other intellectual property rights relating to the images, are retained by Picbazzar
With the purchase of an extended license, the customer acquires the non-exclusive, worldwide, non-transferable and non-sub-licensable right to use the selected images for the Permitted Uses (as defined below). For each of the following permitted extended license uses a separate Extended Licence has to be purchased.
Preview images do not include any further usage rights. Exempt from this is use in designs with regard to the purchase of an image. You may use layout images for design purposes, sample layouts and presentations free of charge. Free layout images may not be used in end products - neither for internal nor external purposes.

The customer is prohibited from assigning, selling, ceding or transferring any rights granted to it under this agreement by sublicense.
Uses that could lead to the disparage of the persons illustrated as well as use in pornographic, defamatory, slanderous, racist, criminal, unlawful or other offensive contexts are prohibited and make the customer liable for damages. The use of images many not infringe upon third party rights, i.e. natural or legal persons.
The online provision of the images s in a downloadable format or distribution of the is not permitted.
The images or portions of the image may not be used in a logo or as trademarks or service marks.
All orders are shipped immediately after payment confirmation.

Thanks for being a patron with Picbazzar. If you are not entirely satisfied with your subscription, we are here to help. Once we receive your Refund request, we will inspect it and notify you on the status of your refund. Once your product/images delivered to your email or dashboard, we do not offer refunds. If your products/images have not been granted for whatever reason, please contact us and your chips will be granted immediately. In case we are unable to grant you chips, your refund will be processed from our end within 7 working days.
The User acknowledges and agrees that he/she/it uses the Website and its Services at the User’s own risk and under the User’s responsibility and, therefore, the Company does not accept any responsibility for misuse or use in breach of these Terms. The User will be responsible for any damages to the Company resulting from the User’s use of the Website and the Services in breach of the Terms and accepts to indemnify the Company and its directors, employees, agents and representatives from any liability in which they may incur as a result of the User’s breach of these Terms. The Company does not warrant the availability or continuity of the Website or the Services, neither its reliability, quality, completeness, accuracy or whether they are fit for a specific purpose or activity. As way of example and without limitation, the Company shall not be liable for any damages that may result from: Interruptions, viruses, technical problems, interferences, omissions, unavailability, power cuts, failure of the telecommunication networks or the User’s equipment which are not the Company’s responsibility. All intellectual property rights over the Website, the Services, and/or the Picbazzar Content, its design, and source code, and all content included in any of them (including without limitation text, images, animations, databases, graphics, logos, trademarks, icons, buttons, pictures, videos, sound recordings, etc.) belong or are licensed to the Company. Except as expressly authorized under these Terms, the reproduction or distribution, as well as transformation, producing any derivative works of any kind, public communication, making available, extraction, reuse or any other use of the Website, the Services, the Picbazzar Content or any of its parts, is strictly forbidden. The Third Party Content and the Sponsored Content are protected by intellectual property rights, as appropriate, and belong to their owners. Although the Services can locate and provide access to these contents, its download and use is subject to the conditions set by the relevant third party. The Company is not the owner and cannot grant any license or authorization in relation to Third Party Content or Sponsored Content. The User must obtain authorizations that are, in each case, required to use any Third Party Content or any Sponsored Content. If the third-party holder of a Third Party Content or Sponsored Content does not want to be included in the Company’s search results, the third party can contact the Company as indicated in these Terms. Regarding a specific Third Party Content or Sponsored Content appearing as a search result, you can use the copyright complaint that appears next to the result. If you believe that any content infringes third party rights or does not comply with these Terms, you can report it to the Company as set forth in these Terms. In addition, you can use the copyright infringement report system that is provided with any result in the Website
The Company may, at any moment, and without incurring in any responsibility towards the User, modify the content of the Website or the Services, limit or modify the conditions or cease to provide some or all the Services and features available or deactivate and delete all or some of the User accounts and their corresponding information. However, the Company will comply with its obligations regarding the keeping of records in relation to certain transactions for the relevant period as provided by applicable law or refund the Users of Subscriptions in force at that time with the proportional part of the price not accrued before the termination.
